1. Introduction

Welcome to Space Art NFT marketplace. By accessing or using our platform, you agree to be bound by these Terms and Conditions. Space Art is a digital art marketplace specializing in curated Latin American NFT art, operating in compliance with applicable laws and regulations.

2. Definitions

Platform: The Space Art NFT marketplace website and associated services.

User: Any person or entity accessing or using the Platform.

NFT: Non-fungible token representing digital artwork on supported blockchains.

Creator: An artist who mints and lists NFTs on the Platform.

Collector: A user who purchases NFTs through the Platform.

3. Account Registration

To access certain features, you must:

  • Connect a compatible Web3 wallet (MetaMask, WalletConnect, etc.)
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Comply with all applicable laws and regulations

4. NFT Transactions

4.1 Minting and Listing

Creators agree that:

  • They own all rights to the digital artwork being minted
  • The artwork does not infringe on any third-party intellectual property
  • All submitted works may undergo curatorial review
  • Gas fees and platform fees apply to all transactions

4.2 Purchasing

Collectors acknowledge that:

  • All sales are final and non-refundable
  • Blockchain transactions cannot be reversed
  • Ownership is transferred via smart contract execution
  • Buyers receive ownership rights but not copyright unless explicitly stated

5. Fees and Payments

The Platform charges the following fees:

  • Platform fee on primary sales: As displayed at time of transaction
  • Royalty fees on secondary sales: As set by the Creator
  • Gas fees: Paid directly to blockchain network validators
  • Payment processing fees: For fiat transactions via Crossmint

All fees are subject to change with prior notice.

6. Intellectual Property Rights

6.1 Creator Rights

Creators retain copyright to their artwork unless explicitly transferred. By minting on the Platform, Creators grant:

  • Space Art a non-exclusive license to display and promote the artwork
  • Collectors the right to display the NFT for personal, non-commercial purposes

6.2 Platform Rights

All Platform content, design, logos, and trademarks remain the property of Space Art.

7. Prohibited Activities

Users may not:

  • Upload content that infringes on intellectual property rights
  • Engage in fraudulent, deceptive, or manipulative practices
  • Use the Platform for money laundering or illegal activities
  • Attempt to hack, disrupt, or compromise Platform security
  • Create fake accounts or engage in wash trading
  • Upload obscene, offensive, or illegal content

8. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED AS IS WITHOUT WARRANTIES OF ANY KIND. Space Art:

  • Does not guarantee Platform availability or error-free operation
  • Is not responsible for blockchain network issues or gas fee fluctuations
  • Does not guarantee the value, authenticity, or legality of NFTs
  • Is not liable for losses from wallet compromises or user error
  • Does not provide investment, financial, or tax advice

9. Indemnification

Users agree to indemnify and hold harmless Space Art, its affiliates, and team members from any claims, damages, or expenses arising from their use of the Platform or violation of these Terms.

10. Termination

Space Art reserves the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities. Users may close their accounts at any time, but existing blockchain transactions remain immutable.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

Space Art may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. Users will be notified of significant changes via email or Platform notification.
